Did Will Smith’s Mercedes SUV bump into accused murderer Cardell Hayes’ Hummer H2 before Hayes shot and killed Smith in New Orleans Saturday night? New video obtained via surveillance cameras show Smith’s SUV coming close or possibly hitting Hayes’ SUV after the shooter abruptly stops in the middle of a New Orleans street.

Fox 8 New Orleans has video of Smith going around Hayes after the incident and then Hayes following behind Smith.

Fox 8 is calling this a possible hit and run. It looks to me like Hayes was intending to be hit. Why else would he stop in the middle of the street so abruptly?

“Prior to the actions that lead to Mr. Smith’s death, my client was involved in a hit and run,” Fuller said. “Someone hit him and failed to pull over. My client trailed behind this person in an effort to get their license plate number. My client also called 911.”

And then Hayes shot a man in the back and left him slumped over and dead in his SUV. Makes sense, right? Here comes the self-defense claim from the defendant. Had to shoot him. Feared for my life. He already hit me. I didn’t know what else he would do. 

According to a cellphone video obtained by NOLA.com, a witness mentions a possible second gun.

“I guess this guy was like, ‘Get out of here or I have a gun,'” the witness says to the camera. “And he goes, ‘F— y’all, I’ve got one too.’ And he grabs the gun and then he shoots him the back – dead.”

The witness’ account does not identify the people speaking at the time. The witness also doesn’t make it clear in the video whether Smith, Hayes or someone else at the scene made the first mention of a gun the witness heard, and also who replied with the expletive and the assertion of also having a gun.
